These Terms & Conditions apply to purchases made via the Momentum Wines ecommerce area of this website. All other forms of purchase are governed by our standard Terms & Conditions, which are available on request.
This page tells you information about us and the legal terms and conditions ("Terms") on which we sell any of the products ("Products") listed on our website ("our site") to you.
These Terms will apply to any contract between us for the sale of Products to you ("Contract"). Please read these Terms carefully before ordering any Products from our site.
You should print a copy of these Terms or save them to your computer for future reference. We may amend these Terms from time to time as set out in clause 6.
These Terms, and any Contract between us, are only in the English language.

2. Our Products
2.1 The images of the Products on our site are for illustrative purposes only. We cannot guarantee that your computer's display of the colours accurately reflects the colour of the Products.
2.2 The packaging of the Products may vary from that shown on images on our site.
2.3 You are responsible for ensuring that the Products that you select are suitable for your purposes.
3. If You Are a Consumer
3.1 If you are a consumer, you may only purchase Products from our site if you are at least 18 years old.
4. If You Are a Business Customer
4.1 If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use our site to purchase Products.
4.2 These Terms constitute the entire agreement between you and us.
5. How the Contract Is Formed Between You and Us
5.1 Our shopping pages will guide you through the steps you need to take to place an order with us.
5.2 After you place an order, you will receive an e-mail from us acknowledging that we have received your order. This does not mean your order has been accepted.
5.3 The Contract between us will only be formed when we send you a Dispatch Confirmation or take an act consistent with fulfilling the Order.
5.4 If we are unable to supply you with a Product we will inform you by e-mail and we will not process your order; any payment will be refunded.
6. Our Right to Vary These Terms
6.1 We amend these Terms from time to time. Every time you order Products from us, the Terms in force at the time of your order will apply.
7. Your Consumer Right of Return and Refund
7.1 If you are a consumer, you have a legal right to cancel a Contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The cancellation period normally ends 14 days after you receive the Product.
7.2 To cancel, contact us — email orders@momentumwines.co.uk, telephone 01691 654499, or write to Unit 8 Mile End Business Park, Maesbury Road Industrial Estate, Maes-Y-Clawdd, Oswestry, SY10 8NN.
7.3 If you cancel we will refund the price you paid (subject to any deduction for handling) and your standard delivery costs. We may reduce your refund to reflect any reduction in the value of the goods caused by your handling them in a way which would not be permitted in a shop.
7.4 Products must be returned in their original packaging.
8. Delivery
8.1 We will contact you with an estimated delivery date.
8.2 If no one is available at your address to take delivery, the carriers will leave a note.
8.3 Delivery is completed when we deliver the Products to the address you gave us; the Products will be your responsibility from that time. Damage visible on delivery should be signed for as damaged; any shortage must be reported within 48 hours.
8.4 You own the Products once we have received payment in full, including all applicable delivery charges.
9. No International Delivery
9.1 We do not deliver to addresses outside the UK.
10. Price of Products and Delivery Charges
10.1 The prices of the Products will be as quoted on our site at the time you submit your order.
10.2 Prices for our Products may change from time to time, but changes will not affect any order you have already placed.
10.3 The price of a Product excludes VAT (where applicable) at the applicable current rate.
10.4 Many product prices include delivery. Where a product incurs a delivery charge this is shown on the product page and in the basket.
11. How to Pay
11.1 You can only pay for Products using the methods stated on our website.
11.2 Payment for the Products and all applicable delivery charges is in advance.
12. Manufacturer Guarantees
12.1 Some Products come with a manufacturer's guarantee — please refer to the manufacturer's terms.
13. Our Warranty for the Products
13.1 For Products without a manufacturer's guarantee, we warrant that on delivery the Products shall be free from material defects.
13.2 The warranty does not apply to fair wear and tear, wilful damage, accident, negligence, misuse, unauthorised alteration or faulty installation.
14. Our Liability If You Are a Business
14.1 Nothing limits our liability for death or personal injury caused by our negligence, fraud, or defective products under the Consumer Protection Act 1987.
14.2 Subject to 14.1, we will not be liable for loss of profits, sales, business or revenue; loss or corruption of data; loss of business opportunity, anticipated savings or goodwill; or any indirect or consequential loss.
14.3 Our total liability shall not exceed the price of the Products.
15. Our Liability If You Are a Consumer
15.1 If we fail to comply with these Terms we are responsible for foreseeable loss or damage. We do not exclude liability for death or personal injury caused by our negligence, fraud, or defective products.
16. Events Outside Our Control
16.1 We will not be liable for any failure to perform our obligations under a Contract that is caused by an Event Outside Our Control.
17. Communications Between Us
17.1 "In writing" includes e-mail.
18. Other Important Terms
18.1 We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights.
18.6 If you are a consumer, these Terms are governed by English law.
18.7 If you are a business, a Contract and any dispute is governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales.
